1. Service Description

MexicoTrademarkCenter.com provides trademark application preparation and filing services before the Mexican Institute of Industrial Property (IMPI). We are an independent filing service and are not affiliated with IMPI, any government agency, or any law firm.

2. No Registration Guarantee

Filing an application does not guarantee trademark registration. IMPI independently examines all applications and may issue office actions, refuse registration, or allow oppositions. Our service is limited to application preparation and submission.

3. Filing Timeline

We target filing within 24 business hours of receiving complete information and confirmed payment. This is a target, not a guarantee. Filing may be delayed if information is incomplete, payment is pending, or other circumstances arise.

4. Classification

Nice Classification suggestions provided by our system are preliminary and subject to professional review before filing. Final classification is confirmed by our team. We are not liable for any consequences resulting from classification decisions.

5. Government Fees

IMPI government fees are separate from our service fees and are subject to change without notice. Current fees are displayed at checkout. We remit government fees to IMPI on your behalf.

6. Scope of Service

Our service covers application preparation and filing only. Office action responses, opposition proceedings, trademark renewals, declarations of use, litigation support, and other post-filing services are not included unless separately agreed in writing.

7. Payment

Payment is required before we commence filing. Payments are processed via Stripe. Refunds are evaluated on a case-by-case basis before filing is initiated. No refunds after IMPI submission.

8. Limitation of Liability

Our liability is limited to the service fees paid. We are not liable for IMPI decisions, examination delays, third-party oppositions, or any commercial damages resulting from trademark status.

9. Not Legal Advice

Information provided on this website and through our service is for informational purposes only and does not constitute legal advice. For legal advice regarding trademark strategy, we recommend consulting a qualified intellectual property attorney.

10. Governing Law; Binding Arbitration

10.1 Governing Law. These Terms are governed by the laws of the State of Florida, U.S.A.

10.2 Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform (a "Dispute") shall be finally resolved by binding arbitration administered by the International Centre for Dispute Resolution (ICDR) under its International Arbitration Rules then in effect. The seat of arbitration shall be Miami, Florida, the proceedings shall be conducted in English, and the tribunal shall consist of a sole arbitrator unless the amount in controversy exceeds USD $1,000,000, in which case three arbitrators shall be appointed. The Federal Arbitration Act governs this Section.

10.3 Class Action Waiver. All Disputes shall be brought solely on an individual basis. No party may bring or participate in any class, collective, consolidated, or representative proceeding.

10.4 Injunctive Relief Carve-Out. Either party may seek injunctive or equitable relief from any court of competent jurisdiction to protect intellectual property rights or confidential information, without waiving its right to arbitrate other Disputes.

10.5 Award; Enforcement. The award shall be final, binding, and enforceable in any court of competent jurisdiction, including under the 1958 New York Convention. Proceedings and the award shall remain confidential, except as required by law or for enforcement.
